NIA Comment on Implementation of the National Environmental Policy Act

NIA appreciates the opportunity to comment on the U.S. Nuclear Regulatory Commission’s proposed rule, Implementation of the National Environmental Policy Act (NEPA). NIA generally supports the Commission’s effort to make environmental reviews more focused, efficient, and predictable. NIA is concerned, however, that the proposed definition of environmental effects may go beyond disciplining the scope of NEPA review and unnecessarily narrow the Commission’s interpretation of its authority under the Atomic Energy Act (AEA) and Energy Reorganization Act (ERA). This comment addresses these concerns and responds to NRC’s specific request for comments.
